1. To participate in a Sparks Speed Dating event, you must register and agree to be bound by these Terms and Conditions (Agreement) and confirm that you have read these Terms and Conditions. This Agreement sets out the legally binding terms for your participation in a Sparks Speed Dating event. Sparks Speed Dating a division of Anel Enterprises, LLC may modify this Agreement from time to time.
By registering for a Sparks Speed Dating event, you are agreeing that Sparks Speed Dating is not liable for any damages, direct or indirect, incidental and/or consequential, arising out of attendance at Sparks Speed Dating events, including, without limitation, to damages arising out of communicating and/or meeting with other participants at these events. Such damages include, without limitation, physical damages, bodily injury and/or emotional distress. You also understand and acknowledge that Sparks Speed Dating events are held at venues of which Sparks Speed Dating has no control. In the event that you are injured or suffer damages in any regard at a Sparks Speed Dating event, you agree to release Sparks Speed Dating from any liability with respect thereto.
2. You must be at least twenty-one years old and single or legally divorced to participate in a Sparks Speed Dating event. By participating in a Sparks Speed Dating event, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions of this Agreement.
3. We will make every effort to hold events at the dates, times and locations specified on our web site/and or flyers. We do reserve the right to cancel and/or change event dates, times and locations although this happens very rarely. In the very unlikely event that circumstances dictate that we do postpone an event, you will be refunded your money in full. You may cancel your participation at any time, for any reason by sending a written notice of cancellation to Sparks Speed Dating via email at info@sparksspeeddating.com . Any cancellation notice received 72 or more hours prior to the scheduled time of the event will be entitled to a refund of your money, minus a $5 processing fee. Any cancellation notice received less than 72 hours before the scheduled time of the event will not be entitled to a refund. Sparks Speed Dating, in its sole discretion, reserves the right to discontinue any discount applied to a registration that is cancelled prior to the event. We also reserve the right to terminate or restrict your participation at a Sparks Speed Dating event, without prior notification. If your rights are so terminated you will not be entitled to a refund.
4. Sparks Speed Dating is not a matchmaking service. Our goal is to help single people meet one another in a safe and comfortable setting. Sparks Speed Dating does not screen participants or verify personal information, such as marital status or any other aspects of their general background. It is up to you to clarify these issues to your own satisfaction. Attendance at any Sparks Speed Dating event is done so at your own risk. You agree to waive all liability against Sparks Speed Dating a division of Anel Enterprises, LLC, and the venue that this event is held at, any sponsors and/or partners associated with Sparks Speed Dating and all staff members and volunteers associated with Sparks Speed Dating.
5. You hereby acknowledge and understand that by participating in any Sparks Speed Dating event your first name and ID #, will be provided to other participants. Your phone number and/or email will be released, with your authorization, for further communications after the scheduled event you attend.
6. Sparks Speed Dating a division of Anel Enterprises, LLC, its affiliates and/or various third parties do not guarantee that any participant will successfully match with any other participant or that participation will be successful or that participation will result in actual dates or introductions. You agree to release Sparks Speed Dating a division of Anel Enterprises, LLC, its affiliates and/or various third parties and assume the full responsibility and risk with respect to the outcome of any relationship that may or may not arise between you and other event participants.
7. Sparks Speed Dating a division of Anel Enterprises, LLC, along with certain permitted third parties, may photograph and/or make audio/video recordings of any of the Sparks Speed Dating events. At no time will there be an audio recording of any actual ‘dates'. Such photographs may be used by Sparks Speed Dating a division of Anel Enterprises, LLC, its agents, representatives, successors and/or assigns for any legal purpose including, without limitation, marketing and advertising. No person shall be entitled to any compensation in connection with the use and exploitation of any photographs, audio and/or video recordings.
8. You agree to indemnify and hold Sparks Speed Dating a division of Anel Enterprises, LLC, its employees, volunteers, business partners, affiliates and/or various third parties, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your participation in any Sparks Speed Dating event.
9. All title, ownership and intellectual property rights, including the rights to copyright, trademarks, service marks and logos (collectively, the “Intellectual Property”) are vested in Sparks Speed Dating a division of Anel Enterprises, LLC. Nothing contained herein should be construed as granting, by implication, estoppel or otherwise, any license or right to use any of the Intellectual Property without the written permission of Sparks Speed Dating a division of Anel Enterprises, LLC.
10. These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
11. You acknowledge that you have read the Sparks Speed Dating policy, the terms of which are incorporated herein. You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder. I HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE.
